Terms of Service

Effective date: August 12, 2026

These terms govern use of Mosto, a service operated by MOSTO LLC ("Mosto," "we," "us") of Saint Paul, Minnesota. By creating an account or using Mosto, you agree to these terms and to our Privacy Policy. If you use Mosto on behalf of a business, you represent that you are authorized to bind that business to these terms.

The service

Mosto helps restaurants manage employee illness reporting: logging sick calls, sending wellness check-in texts, applying health-code-based guidance about exclusion and return-to-work timing, and keeping records. We may improve or change features over time.

Accounts

You are responsible for the accuracy of the information in your account, for keeping your password confidential, and for the activity of the managers you invite. Tell us promptly at hello@getmosto.com if you believe your account has been compromised.

Employer responsibilities

Employers using Mosto agree to:

Not medical or legal advice

Mosto's guidance — including symptom screens and return-to-work suggestions based on food-code rules — is informational only. It is not medical advice, legal advice, or a substitute for the judgment of health authorities or qualified professionals. Employers remain solely responsible for their compliance decisions and for the treatment of their employees.

Acceptable use

You may not use Mosto to send unlawful, harassing, or deceptive messages; to message people who have not consented; to probe or disrupt the service; or to access data belonging to another business. We may suspend accounts that put the service or other users at risk.

Text messaging

Text messages are delivered through third-party carriers and may be delayed or fail for reasons outside our control. Recipients can opt out at any time by replying STOP. Do not rely on Mosto texts as the sole channel for urgent communication.

Fees

If and when Mosto charges fees, pricing will be presented before you commit to a paid plan. We will not convert a free account to a paid one without your agreement.

Intellectual property

Mosto and its design, code, and content are the property of MOSTO LLC. Your data remains yours; you grant us only the rights needed to operate the service for you.

Availability, warranties, and liability

Mosto is provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent permitted by law, MOSTO LLC will not be liable for indirect, incidental, special, or consequential damages, and our total liability for any claim relating to the service will not exceed the amounts you paid us for the service in the twelve months before the claim (or $100 if you have paid nothing). Nothing in these terms limits liability that cannot be limited by law.

Termination

You may stop using Mosto and close your account at any time by emailing hello@getmosto.com. We may suspend or terminate accounts for breach of these terms. Sections that by their nature should survive termination survive it.

Changes

If we make material changes to these terms, we will update this page and its effective date and notify account holders by email. Continued use after changes take effect constitutes acceptance.

Governing law

These terms are governed by the laws of the State of Minnesota, and disputes will be resolved in the state or federal courts located in Ramsey County, Minnesota.
